CBD products are legal in Georgia, with the exception of CBD in foods, beverages, animal feed, or dietary supplements. The Georgia Hemp Farming Act, HB 213, which passed in May 2019, formally legalized the commerce of CBD products that conform with federal law requirements and contain 0.3% THC or less.

Georgia has had a restricted medical marijuana program in place since 2015. Qualifying patients can access CBD-rich cannabis oil that contains 5% THC or less. Adult-use cannabis remains illegal. Several municipalities in Georgia have effectively decriminalized the possession of small quantities of cannabis.

What is CBD?

CBD is a non-intoxicating cannabinoid found in cannabis and the second-most prominent in the plant after THC, which is largely responsible for producing an intoxicating high. CBD can be sourced either from marijuana or hemp plants and has a wide range of potential therapeutic benefits.

To date, researchers have identified a number of potential applications linked to CBD, including anti-inflammatory, analgesic, anti-anxiety, and anti-seizure properties. Further, the chemical has shown promise in treating numerous health conditions, including seizure disorders, mood disorders such as depression, anxiety, and psychosis, chronic pain, and many more.

Most raw cannabis strains on the market today contain small amounts of CBD, especially compared with THC. But since the cannabinoid has gained considerable attention for its wide range of purported therapeutic benefits, more high-CBD strains have recently been cultivated.

Why is CBD sometimes illegal?

All types of cannabis, including hemp strains that don’t produce enough THC to cause intoxication, were considered illegal under the Federal Controlled Substances Act of 1970. The law categorized all cannabis as Schedule 1, which defined the plant as a highly addictive substance with a high potential for abuse and no accepted medical use.

The 2018 Farm Bill re-classified hemp as an agricultural commodity and made its cultivation federally legal. Further, the act removed some forms of cannabis from Schedule 1 status by creating a legal distinction between hemp and marijuana. Hemp is cannabis with less than 0.3% THC, and marijuana refers to cannabis with more than 0.3% THC. This distinction in federal law effectively legalized CBD that is derived from cannabis with less than 0.3% THC, as long as it has been cultivated according to federal and state regulations.

The 2018 Farm Bill legislation does not mean that CBD derived from hemp is universally legal throughout the United States. According to the Farm Bill, the Food and Drug Administration (FDA) has the power to regulate CBD product labeling, including therapeutic claims and the use of CBD as a food additive.

The FDA has declared that even hemp-derived CBD may not legally be added to food and beverages, or marketed as a dietary supplement. Although the organization has begun to re-evaluate some of its stances on legal CBD products, the FDA has not revised its regulations. The agency also has been strict in its position against any labeling that could be perceived as a medical claim about CBD.

In addition to the federal regulation of CBD, the Farm Bill also gave states the option to regulate and prohibit the cultivation and commerce of CBD. States may regulate CBD in food, beverages, dietary supplements, and cosmetic products independently, even before the FDA finalizes its policies. Georgia is a state that closely adheres to the FDA stance regarding CBD as an additive in food, animal feed or dietary supplements.

Georgia CBD laws

Until May 2019, only CBD products with zero percent THC were legal in Georgia. The passing of HB 213, also known as the Georgia Hemp Farming Act, permitted the in-state production, processing, and sale of hemp and hemp products, and redefined CBD to match the federal definition.

Georgians can now legally purchase CBD products containing no more than 0.3% THC by dry weight. The Georgia Department of Agriculture, which is responsible for the state’s industrial hemp program, has released a declaration prohibiting the sale of CBD in food, drink, animal feed, or dietary supplements.

In April 2015, Gov. Nathan Deal signed HB 1 into law. Also known as Haleigh’s Hope Act, this legislation allowed the use of CBD-rich oil derived from cannabis that contained no more than 5% THC for patients with qualifying medical conditions. While the law created the skeleton of a medical marijuana program for patients, it didn’t address how low THC oil would be produced, nor did it develop regulations around the purchase or transport of such products.

Haleigh’s Hope Act ensured only that qualified patients would be safe from prosecution for possession of low THC oil. On April 17, 2019, Gov. Brian Kemp signed HB 324, Georgia’s Hope Act, a bill that set up a regulatory system for the Georgia Department of Public Health (GDPH) to license and regulate the production and sale of low THC oil for patients. The bill allows for up to six private companies and two universities to grow and manufacture low THC cannabis oil.

Pharmacies will initially sell cannabis oil, and private dispensaries can apply for a license to distribute low THC oil to patients. Dispensaries are expected to open in 2020.

Licensing requirements for CBD

The Georgia Department of Agriculture (GDA) is responsible for the oversight of hemp cultivation and production in the state. The GDA is currently in the process of drafting regulations surrounding the licensure and rules of the hemp farming program.

Until the regulations have been released, no licenses will be issued. Only entities with a license from the GDA will be legally permitted to grow and process hemp and hemp-derived CBD. The cultivation of hemp without a license is illegal. Although the GDA is still drafting regulations, HB 213 outlines some preliminary guidelines for those who wish to cultivate hemp.

Applicants must undergo a criminal background check performed by local law enforcement. Those with convictions related to controlled substances are not eligible to apply for licenses. Applicants must be qualified with agricultural experience. Annual licensing fees cost $50 per acre, with a maximum fee of $5,000.00.

Written consent must be provided for the GDA to inspect premises where hemp is grown. Licensees must provide samples of hemp and hemp-derived CBD products through internal personnel or via independent lab testing contractors. Lab tests must prove that the sample contains no more than 0.3% THC. Crops with more than 0.3% THC must be destroyed.

Georgia CBD possession limits

Georgia has no possession limits on hemp-derived CBD products as long as the products contain no more than 0.3% THC by weight.

Georgia law authorizes the legal possession of up to 20 fluid ounces of low THC cannabis oil by qualified patients. The possession of any form of marijuana by an unauthorized person is a violation of state and federal law.

The penalty for possession of an illegal form of CBD product or cannabis scales depends on the amount in possession and whether there is an intention to distribute. Possession of more than 1 ounce is a felony punishable by up to 10 years in prison and $5,000 in fines.

Possession with intent to distribute is punishable by the same penalty tiers as the sale of illicit CBD or cannabis.

Where to buy CBD in Georgia

Georgia consumers can purchase hemp-derived CBD products from CBD-specific stores and health shops. While cafes and grocers may stock foods or beverages infused with CBD, the sale of these are prohibited by Georgia law.

When purchasing from a storefront, particularly if the store specializes in CBD, you can receive guidance from an employee. Explain what you’re looking for, your reasons for consuming CBD, and they can point you in the right direction.

Georgia residents can also buy hemp-derived CBD online, usually through specific brands’ websites. You can also find verified CBD brands on Weedmaps. Reputable brands will generally provide you with essential product details, including the form of the CBD (such as oil, capsules, topicals, tinctures, etc.), the quantity of CBD the product contains, the other chemicals or ingredients present in the product, and more.

While many online checkout systems support US-based CBD sellers, some companies like Paypal consider CBD a “restricted business” and don’t support online sales. Confirm the websites’ checkout system before purchasing CBD online.

How to read CBD labels and packaging

The 2018 Farm Bill shifted the oversight of hemp and hemp-derived products from the U.S. Department of Justice (DOJ) to the U.S. Food and Drug Administration (FDA). The FDA does not presently allow CBD-infused food, drinks, or dietary supplements to be sold, and hasn’t yet provided regulations for hemp-derived CBD products.

Still, the agency warns that regulations in flux still require companies to make legitimate claims on their labels. Buyers should nonetheless approach CBD products with caution. A CBD product should clearly state what kind of CBD is used.

Full-spectrum CBD oil means the extract contains cannabis-derived terpenes and trace amounts of cannabinoids such as THC. Broad-spectrum also includes other cannabis compounds but has had THC removed during the processing phase. CBD isolate is a pure crystalline powder containing only CBD.

Most reputable CBD producers typically include the following information on their CBD product labels:

  • Amount of active CBD per serving.
  • Supplement Fact panel, including other ingredients.
  • Net weight.
  • Manufacturer or distributor name.
  • Suggested use.
  • Full-spectrum, broad-spectrum, or isolate.
  • Batch or date code.

Is CBD Actually Legal in Georgia?

In the past decade, public opinion on medical and recreational marijuana legalization has seen a major shift, with a majority of Americans supporting legalization as of last year. In the wake of this shift, 11 states have legalized recreational use and 33 have legalized medical marijuana. Georgia legislature joined the trend in legalizing medical marijuana this past April. However, the few qualified recipients still face major hurdles when purchasing the substance. In addition, in December 2018, the federal government legalized the sale of products derived from hemp, a cannabis plant with 0.3% or less of the psychoactive ingredient THC. Due to the combination of these state-level marijuana restrictions along with the federal legalization of hemp, CBD products have skyrocketed in the past several months, popping up as ingredients in everyday items like coffee and ice cream as well as entire storefronts dedicated to all things CBD.

But first, what is CBD? And, more importantly, is it legal to purchase, use, and possess in Georgia?

CBD stands for cannabidiol, and is a prominent chemical in cannabis plants including hemp and marijuana, along with THC. However, unlike pure THC, CBD does not appear to have “psychotropic” effects. More simply, it won’t get you high. But, to make things complicated, CBD products made from hemp claim to contain as much as 0.3% THC. Further, the CBD industry is not currently regulated, so these claims and the actual THC levels in products are unpredictable.

So, how does this fit in with current Georgia law? According to GA Code § 16-12-191 , only qualified, registered recipients of medical hemp and marijuana may legally possess a limited amount of low THC oil. These recipients are defined under GA Code § 31-2A-18 . Additionally, under GA Code § 16-12-191, anyone who isn’t a registered medical recipient and possesses 20 fluid ounces or less of low THC oil will face a misdemeanor, while possession of more than 20 fluid ounces is a felony.

Essentially, it is illegal to possess or use any amount or form of THC under current Georgia law—unless you are a registered medical recipient of the substance. Many CBD stores and products advertise themselves as containing no THC. The problem with this is that, aside from testing the THC levels of these products, there is no way to substantiate these claims.

A recent newsworthy arrest highlights this problem. This past April, a 69-year-old great-grandmother was arrested and charged with a felony at Disney World after a police officer found CBD oil in her purse at a security checkpoint. She was prescribed the oil for her arthritis by her doctor back home in Tennessee. The 1-ounce bottle she carried with her claimed to contain zero milligrams of THC, but a police test of the oil showed differently when it came back positive for THC. Because her CBD oil was found to contain THC, the great-grandmother was arrested and escorted off the property. While the absurd event happened in Florida, the same legal restrictions on THC apply under Georgia law as well.

With the current CBD craze and Georgians having more access to these products than ever before, it is important to understand the legal risks and implications of purchasing and using CBD products. The use of any products that contain THC can affect Georgians’ lives in many ways—from failing a drug test to being charged with a Marijuana DUI. If possession or use of CBD products containing THC by you or another person has affected you in any way legally, contact the MG Law office for a free consultation.

Essentially, it is illegal to possess or use any amount or form of THC. The problem with CBD is verifying the THC levels. Learn more on this subject here!

For use as a supplement, take one tablespoon of this food-grade oil per day. You can also use it topically as a skin moisturizer or massage oil to help manage symptoms from skin conditions such as eczema and psoriasis. It can also improve your overall complexion.

You can find DIY beauty recipes that contain hempseed oil on the Sky Organics website.

    Foods Alive Organic Hemp Oil

Cost: Around $20 for 16 oz.

This cold-pressed, organic hemp oil has a rich nutty flavor and is full of nutrients, including essential fatty acids. It’s produced in small batches in Canada.

To ensure a high-quality product, the hemp seeds are specially selected and tested for taste, smell, and appearance.

This hemp oil can easily be added to dressings, smoothies, and soups. To use as a supplement, take one tablespoon per day.

Most quality hemp oils have been cold-pressed using a modern steel press. This process helps the oils maintain their full nutritional value, flavor, and aroma.

When choosing a hemp oil, always buy from a reputable manufacturer that’s clear about their practices and standards.

They should be willing to answer any questions and provide appropriate documentation to support their claims. Many companies offer a money-back satisfaction guarantee.

The increased focus on hemp, marijuana, and CBD has led to many questionable companies offering products that are mislabeled and don’t live up to their claims.

Beware of companies that make wild or exaggerated health claims. To get a feel for the company, visit their website.

Hemp oil can be used topically as a moisturizer on its own or diluted with other oils, lotions, or hair products.

When used topically, you don’t need to wash off the hemp oil. It can safely absorb into your skin.

You can also use it as an oil cleanser. In this case, you do need to rinse it off after use.

Hemp oil can also be taken orally in a few ways. To use hemp oil as a supplement, take one tablespoon per day.

It can also be added to salad dressings, soups, and sauces, or used in oatmeal, smoothies, and baked goods. Make sure you like the taste before adding it to a large serving of food.

Hemp oil can be taken at any time of day.

Hemp oil is legal and doesn’t contain THC or CBD. It won’t cause you to feel “high” or test positive on any drug test. Hemp oil is generally well-tolerated, but it can cause digestive side effects, such as cramps, diarrhea, and nausea, in some people.

When taking hemp oil orally, always start with a small dose and gradually increase the amount you take over a period of time, especially if you have a sensitive stomach.

Using hemp oil on your skin may produce mild irritation. Always do a skin patch test before using hemp oil on your skin. To test for allergic reactions, place a small amount on the inside of your arm and wait 24 hours to see if any reaction occurs.

If you have any medical conditions or take any medications, talk to your doctor before starting to take hemp oil.

When used properly, hemp oil can be a healthy addition to your wellness and skin care routine. Choose a product carefully, and always follow the manufacturer’s directions.

Be aware of how the oil affects you when used topically or taken orally. Adjust your use accordingly, and discontinue it if any adverse effects occur.

Hemp oils may be sold for topical or oral use. When choosing a hemp oil, it's important to pick a high-quality one. Here are 11 of our favorite oils.

Brookstone cbd pillow

[EDITOR’S UPDATE, November 4, 2:20PM PST. Added one customer’s comments and review information below. A clarification was also made regarding the CBD oil’s infusion into the memory foam, not the pillow cover.]

With CBD now being more popular online than Jesus, The Beatles, Beyonce, or Pornhub, it’s no surprise that weed’s second-most famous molecule is ending up in everything from deodorant to cosmetics to sports bras. Now, you can add pillows to that list, too.

Offered by the bedding company Brookstone, the company’s “CBD-Infused Bed Pillow” is currently available at Bed, Bath, and Beyond, giving a whole new meaning to that “Beyond” category.

According to the product description, “CBD oil is infused into the pillow,” presumably directly into its 100-percent memory foam material. The product is supposed to help people get a good night’s rest, but let’s unpack that, shall we?

Some studies suggest CBD, a non-intoxicating component of weed, can alleviate anxiety and combat insomnia. But CBD oil applied topically will only affect the outer layer of the skin and hair. There’s some evidence that CBD can facilitate skin healing or hair repair, but more research is needed to confirm these properties.

The best way to get CBD oil from the skin into the bloodstream (where it could encourage better sleep) is with transdermal carriers mixed into the oil. Naturally, oils extracted from weed won’t penetrate the outer skin layers without some additional chemistry.

Yet, nowhere in Brookstone’s or Bed, Bath, and Beyond’s listings mentions if the pillow’s CBD oil contains transdermal agents. In other words, without transdermal additives, like direct application emu oil, the only way this pillow is going to help you sleep is if you suck on it or smoke it. Neither of which are activities you’d do with a pillow.

Gallery — Feel-Good CBD Memes You Can’t Get High On:

What’s the pillow actually like? Professional budtender and cannabis events strategist Andrew Mieure bought one and tried it out. Here’s what he had to say (though, to be fair, he’s only tried it for one night, so far).

“I was left with a stiff neck and a strange smell in my nose,” he told MERRY JANE over text. “Decent quality pillow, albeit, too firm for my liking. The CBD had zero noticeable calming or well-being effects.”

As for the smell, Mieure described it as “manufactured rubber and synthetics.” He added, “It needs to be aired out when it first comes out of the package. It does not smell herbal, or cannabis-like in any way.”

The packaging states that the CBD oil is infused directly into the pillow’s memory foam material, not in the pillow cover. So, the oil is not making direct contact with the skin, most likely.

Another issue with this CBD pillow is that it’s probably a one-shot deal. As in, once you pop it in the laundry after a few weeks of use (you do regularly wash your pillows, right?), you’ll probably wash out whatever CBD oil was infused into the memory foam.

With a listing price of $60, you’re basically paying for an expensive pillow that may or may not freshen your skin. And whether it does or doesn’t, the CBD is going to wash out the second you put it in the washing machine.

For $60, you can realistically buy a whole bottle of potent, CBD-rich tincture, which would likely last much, much longer and work lightyears better than this gimmicky pillow.

Okay, the CBD craze has officially gone to people’s heads.

CBD Oil in Corpus Christi, Texas

Looking for CBD Oil shops near Corpus Christi, TX? We’ve got your covered.

Our favorite CBD product can be purchased online for delivery to Corpus Christi, TX:

If you’re looking for a more local option, check out the information below.

CBD Basics in Corpus Christi

As of February 2018, Texas became among 17 states to welcome in CBD hemp oil. Though currently 4 months later, this product is only slowly making its way to the shelves. Under the Texas Compassionate Use Act, epilepsy patients in particular are legally allowed to use medical marijuana and low THC CBD oil for treatment. There’s some unfortunate language attached to this “act of compassion” however, requiring patients to have tried 2 federally regulated pharmaceutical drugs before being prescribed medical marijuana. Check here for more information on how to obtain a medical marijuana card. That being said, CBD is for sale in Texas with the strongest presence in Dallas and Houston. We anticipate an abundance of CBD across the state in the very near future. Texas laws and a few policies probably won’t stand in the way of money to be made as CBD production and sales is big business and we anticipate that Texas will be on board relatively soon. That being said, know your CBD products well as the industry is not regulated by the FDA. This is a very good thing, but of course means that anything from a stick of hemp to a critically extracted full-spectrum CBD oil are available on the market. If you can’t find the CBD oil products you love in Corpus Christi, we recommend shopping online for quality products. Brands like Charlotte’s Web, 4 Corner’s Cannabis, CBD Life, Kat’s Naturals, and ENDOCA are just a few of the quality products on the market. If you would rather talk to someone in person, or simply need CBD that day, try health food stores, local grocery stores, head shops, and vape shops. Call ahead as not all locations are not currently advertising the sales of CBD.

CBD Oil in Corpus Christi, Texas

If you are looking to find CBD oil near Corpus Christi, we recommend calling ahead. Try vape shops, head shops, health food stores, and even gas stations. You can even try calling a few of these established businesses: Kickin Ash Vapor Solutions (505 S Water St. Ste 519) is a vape shop that offers a wide-variety of vape juices, mods and other accessories. Not only that, but vape provides a much healthier alternative to smoking cigarettes- hence the name of the shop. Vaping CBD provides almost instantaneous relief. The prices at the shop are considered good for the quality of product. Call ahead and check to see if they have stocked CBD vape liquids. Vapor Waves (2033 Airline Rd.) is located near both the Oso Bay and Corpus Christi Bay. The prices are slightly higher but the staff are friendly, the shop is clean and Vapor Waves carries premium juices, Mods, tanks and more. Be sure to check in and ask for CBD vape and other CBD oil products. The hope is that when shops start to recognize that there is a demand for the product, they’ll carry it. Other head shops to watch in Corpus Christi include Galactic Papes and Vapes (3521 St. Staples St.), JG’Z Vape Lounge (5702 McArdle Rd. St. A), and Pipin Vapes (1247 Nile Dr.)

Frequently Asked Questions About CBD Oil

Many people want to know if CBD oil will make them “high.” The answer is no. Commercial CBD oil products- the products nationally legalized in 2014 only require low doses of THC, the psychoactive component of cannabis. In fact, a CBD oil product legally contains no more than 0.3% of THC which is not enough to impair an individual or make them feel “high.” However, that level of THC is detectable in the body. So yes, it will show up on a drug test. With that in mind, this is only with the use of full-spectrum CBD oil products. Full Spectrum products are highly desirable for the entourage effect where all components of the cannabis plant work harmoniously to provide a strong therapeutic effect. Many individuals, however, do not want to risk their jobs and prefer to take instead isolated CBD oil products that actually remove all of the THC. You will still reap the benefits of a CBD hemp oil but without the risk of this product showing up on a drug test. Brands like Green Roads and Kat’s Natural are known for creating fantastic isolated spectrum CBD products.

That brings to an end our summary of the best places to buy CBD near Corpus Christi, TX.

Can CBD Help Energy and Focus?

We include products we think are useful for our readers. If you buy through links on this page, we may earn a small commission. Here’s our process.

Cannabidiol (CBD) use is on the rise, with many people trying it for a variety of reasons.

Some people use CBD for energy and focus — but can it really help? Here’s what you need to know about using CBD for concentration and energy.

Many factors can affect our energy and concentration. Chronic conditions, lack of sleep, stress, and diet can all influence our energy levels.

At present, there’s very little evidence that suggests CBD could improve energy and focus.

One 2014 research review did note that CBD might promote wakefulness for some people, although the researchers add further research should be conducted.

But there’s promising research that suggests CBD can improve other issues that may affect your energy levels and ability to concentrate.

CBD for tiring anxiety and stress symptoms

For example, anxiety disorders might cause you to feel fatigued and have difficulty concentrating.

CBD might reduce the symptoms of PTSD and social anxiety disorders. So, if PTSD symptoms, social anxiety, or both cause you to lose focus and feel fatigued, CBD might be able to help you.

CBD for sleep issues

Another example is sleep. If you’re struggling to sleep properly, you might feel tired and lack focus the next day.

CBD might be able to help with certain sleep disorders. In this case, CBD might help you get a good night’s sleep, which may help you feel energetic and focused more often.

CBD for pain

CBD might also help with pain, which can also cause you to struggle with concentration and experience fatigue.

It’s important to note that CBD hasn’t been definitively proven to “cure” any of the above conditions. More research is needed.

For the purpose of this article, we chose a range of CBD products that might be able to help with sleep issues, pain, and anxiety, all of which might hinder your ability to feel energized and focused.

We chose CBD products based on criteria we think are good indicators of safety, quality, and transparency. Each product in this article:

  • is made by a company that provides proof of third-party testing by an ISO 17025-compliant lab
  • is made with U.S.-grown hemp
  • contains no more than 0.3 percent THC, according to the certificate of analysis (COA)
  • passes tests for pesticides, heavy metals, and molds, according to the COA

We also considered:

  • company certifications and manufacturing processes
  • product potency
  • overall ingredients
  • indicators of user trust and brand reputation, such as:
    • customer reviews
    • whether the company has been subject to a Food and Drug Administration (FDA) warning letter
    • whether the company makes any unsupported health claims

Pricing guide

  • $ = under $40
  • $$ = $40–$60
  • $$$ = over $60

While shopping for CBD products, you might notice some of the following terms. Here’s what they mean:

  • Terpenes are compounds found in cannabis and hemp plants that give it a flavor and aroma. It’s believed that terpenes might be able to enhance the benefits of CBD.
  • CBD isolate is pure CBD, with no other cannabinoids or terpenes included in the product.
  • Broad-spectrum CBD contains most cannabinoids, but some are purposefully removed. (Usually tetrahydrocannabinol, or THC — the cannabinoid that produces the “high” effect — is removed.) It often contains terpenes.
  • Full-spectrum CBD contains all cannabinoids found in the plant, including THC. It usually contains terpenes, too.

LiftMode Hemp Extract Oil, Calm

  • Price : $
  • CBD type : Full-spectrum (less than 0.3 percent THC)
  • CBD potency : 1,500 mg per 30-mL bottle
  • COA :Available online

Price: $

If poor sleep is causing your fatigue, LiftModeHemp Extract Oil in Calm might be worth trying. This CBD oil includes melatonin, a hormone that regulates the sleep cycle. Melatonin is often taken as a sleep supplement. LiftModeHemp Extract Oil also includes chamomile and lavender oils.

Ojai Energetics Full Spectrum Hemp Elixir

  • CBD type : Full-spectrum
  • CBD potency : 250 mg per 30-mL bottle
  • COA :Available online

Price: $$$

Ojai Energetics Full Spectrum Hemp Elixir is an example of “nano CBD”: The molecules in the CBD oil are nano-sized (that is, super small). These tiny molecules are designed to pass into the bloodstream more easily, which means that it’s more bioavailable. Because the molecules are tiny, they can be mixed into water — usually, water and oil don’t mix.

Because this CBD is water-soluble, you’ll need less for it to work. The oil also includes extracts of moringa and acerola cherry.

According to the website, 250 milligrams (mg) of the oil is equivalent to 5,000 mg of regular CBD oil. (But this claim hasn’t been independently verified.)

Ojai offers a “subscribe and save” program, and offers an assistance program for those seeking affordable CBD.

Green Gorilla CBD Gorilla Gummies, 300mg

Use code “healthline” for 15% off.

  • CBD type : Isolate
  • CBD potency : 5mg per gummy
  • Count : 60 gummies per container
  • COA :Available online

Price: $$

These CBD gummies are vegan, kosher, and THC-free. One bottle contains a mixture of flavors: Strawberry, Wild Berry, and Gorilla Berry. Each gummy contains 5 mg CBD. The company recommends that you take between two and four per day.

If you want to test it out before buying a large bottle, you can purchase a pack of four gummies. There’s an option to subscribe for a recurring delivery to receive a 10 percent discount. The company is also currently offering a free product to first responders.

Sunday Scaries Vegan CBD Gummies

Use code “healthline20” for 20% off

  • CBD type : Broad-spectrum
  • CBD potency : 10 mg per gummy
  • Count : 20 gummies per bottle
  • COA :Available online

Price: $

These vegan CBD gummies contain 10 mg CBD each. They’re sugar-coated and come in lemon, lime, tangerine, and cherry flavors.

The gummies also contain vitamins B12 and D3. A lack of vitamin B12 can lead to fatigue, so if you need to include more of those vitamins in your diet, this might be a good buy.

Sunday Scaries offers a discount for those who subscribe to purchase their items.

GoGreen Hemp CBD Balm Salve

  • CBD type : Broad-spectrum
  • CBD potency : 500 mg–4,000 mg per 4-oz. container
  • COA :Available online

Price: $$$

It’s difficult to concentrate while you’re in pain, and constant pain can drain your energy. If you’re experiencing pain in a specific area, a CBD balm might be helpful.

GoGreen Hemp CBD Balm Salve is beeswax-based and includes fragrant eucalyptus and lavender oils. According to online reviews and forums, many people use this for helping manage arthritis and fibromyalgia as well as injuries.

This salve comes in a range of potencies and sizes. Choose a stronger one if your pain is more severe.

GoGreen Hemp offers an assistance program with a 20 percent discount for active service members, veterans, disabled people, and people with a low income.

Shopping for CBD products can be overwhelming, but it’s important to read a CBD product label before making a purchase. This will help you figure out whether you’re buying high-quality CBD.

The FDA doesn’t regulate CBD products for quality, which means there are many low-quality products out there.

Check out the packaging

The packaging must specify that it contains CBD (it might use the full word, cannabidiol). If the ingredients list only includes hemp or hempseed oil, it probably doesn’t contain CBD at all.

Look for lab-tested

CBD products must be tested by an independent and compliant lab. The lab results (also known as a certificate of analysis, or COA) are usually available on the company’s website.

Some companies provide a QR code on the packaging that leads to a COA. The COA should ideally be recent and dated within the past year.

COAs are important because they confirm the contents of the product. A COA should specify the amount of CBD in the product. COAs often test for other cannabinoids and terpenes as well as harmful toxins, like molds and traces of pesticide.

Consider the extra ingredients

CBD oils use carrier oils like MCT oil, hempseed oil, grapeseed oil, or cranberry oil. They sometimes use flavorings too. CBD edibles and topicals can contain numerous ingredients. Pay attention to these ingredients in case of allergies.

Marketing claims

CBD companies might also make other claims about their products. However, it’s difficult to verify these claims.

For example, some companies claim that their products are created from organic and U.S.-grown hemp. However, the U.S. Department of Agriculture (USDA) doesn’t regulate what is labeled “organic” and what is not.

Similarly, the claim that their hemp is grown in the United States might be difficult to verify because the USDA doesn’t regulate this.

Some companies might label their items as vegan. CBD items seldom contain animal products, although some gummies contain gelatin, and edibles may contain eggs and dairy.

However, if you’re vegan, it’s a good idea to look out for the “vegan” label for peace of mind.

When it comes to CBD dosage, it’s a good idea to start with a small amount every day. After a while, reassess how you feel. If you think you need a higher dosage, increase it gradually.

It might be a good idea to track your dosage and your symptoms. You can do so in a paper journal or a notes app on your phone.

When in doubt, speak to a CBD-knowledgeable doctor. They might be able to advise you on how much CBD to take.

Research suggests that CBD is safe for human consumption. There are a handful of potential side effects, though, including:

  • fatigue
  • diarrhea
  • changes in appetite
  • changes in weight

Some research suggests that consuming CBD with high fat meals could drastically increase CBD blood concentrations. This can increase your chances of experiencing side effects.

CBD might interact with certain medications. If you’re using a medication that carries a grapefruit warning, avoid taking CBD without your doctor’s approval. This is because CBD and grapefruit both change the way your liver metabolizes certain substances.

To be on the safe side, it’s always best to talk to a doctor before using CBD, no matter your health status.

There are many other ways to build stamina, boost energy, and increase focus.

  • ensuring you get plenty of quality sleep
  • eating a nutritious, balanced diet
  • exercising regularly
  • avoiding smoking and heavy alcohol use
  • drinking enough water
  • reducing stress where possible
  • taking any supplements as directed by your doctor

If you’re constantly dealing with fatigue and concentration, it might be a good idea to speak to your doctor. They could help pinpoint the cause and talk about remedies.

Is CBD Legal? Hemp-derived CBD products (with less than 0.3 percent THC) are legal on the federal level, but are still illegal under some state laws. Marijuana-derived CBD products are illegal on the federal level, but are legal under some state laws. Check your state’s laws and those of anywhere you travel. Keep in mind that nonprescription CBD products are not FDA-approved, and may be inaccurately labeled.

Shipping cbd oil across state lines

The legislation regarding mailing hemp and CBD have recently changed to allow hemp products to be shipped legally. The Agricultural Improvement Act of 2018 (2018 Farm Bill) removed hemp from the federally controlled substance list which allows for hemp products to be shipped between states as of June 6, 2019. If you plan on shipping CBD or hemp products you’ll want to review the changes to ensure your business is operating within the law.

2018 Farm Bill

Based on this new legal status, hemp plants, seeds, and products can now be mailed through USPS to domestic addresses—military and international destinations are currently excluded. In addition to destination restrictions, there are a few conditions you must meet to ship hemp products. For starters, shipping industrial hemp products require a license from a state’s Department of Agriculture authorizing the production. Additionally, the tetrahydrocannabinol (THC) concentration in a product cannot exceed a 0.3% limit. If you are shipping liquid hemp products be sure to follow the USPS guidelines to ensure leaks won’t cause your package to become unmailable.

Shipping with USPS

The USPS hemp and CBD shipping regulations align with the Agricultural Improvement Act of 2018. This means that you can use the USPS to mail hemp/CBD products domestically, as long as your shipment meets the following requirements. The Agricultural Improvement Act states:

  • “Hemp” shall have the meaning provided under federal law, including Section 10113 of the Agricultural Improvement Act of 2018, Pub. L.115-334 (7 U.S.C. § 1639o), or any successor provision. Hemp and hemp-based products, including cannabidiol (CBD) with the tetrahydrocannabinol (THC) concentration of such hemp (or its derivatives) not exceeding a 0.3 percent limit are permitted to be mailed only when:
    • The mailer complies with all applicable federal, state, and local laws (such as the Agricultural Act of 2014 and the Agricultural Improvement Act of 2018) pertaining to hemp production, processing, distribution, and sales; and
    • The mailer retains records establishing compliance with such laws, including laboratory test results, licenses, or compliance reports, for no less than 2 years after the date of mailing.

It is important to note that it is the mailer’s responsibility to remain compliant with all laws and regulations governing mailability. Make sure to maintain your own records of compliance, including laboratory test results, licenses, and compliance reports for at least 2 years your mailing. USPS can request this documentation if there are any questions on the product’s mailability or the ability to legally receive the shipment so it’s important you have the documents on hand. These documentation requirements are not unique to hemp products however, they apply to all restricted items shipped with USPS.

Is It Legal to Mail CBD Oil? [Here’s What the Laws Say]

One of the main reasons we started WayofLeaf was to ensure people had access to up to date, accurate information about the globe’s hemp and cannabis markets. It is a challenging endeavor! The laws surrounding marijuana and industrial hemp in the U.S. alone seem to change with astounding regularity, and little of the legislation is particularly evident.

The fact that marijuana is federally illegal in the United States is one of the few things we can all agree on! It is legal for recreational use in 11 states and D.C., and there are medical marijuana programs in 22 other states at the time of writing. For the time being, at least, the government has shown no inclination to interfere in state’s rights regarding weed. The removal of Jeff Sessions as Attorney General helped alleviate a great deal of concern.

While marijuana and THC laws seem fairly clear (for now), confusion riddles the CBD industry over the legality of the substance. Several websites erroneously claim that CBD is entirely legal in all 50 states. The truth is less rosy for the industry, although there is basically no implementation of these laws!

When it comes to transporting hemp oil across state lines, especially in mail form, an increasing number of prospective consumers are nervous. “Will I get caught?” “What are the punishments for using CBD oils in a state where it is apparently illegal?” Such concerns prevent people from trying cannabidiol. Let’s try to set the record straight in this article.

CBD Laws – Noise & Confusion

Technically, CBD is not legal in all 50 states. If you go to Nebraska, South Dakota, or Idaho, the law suggests that the non-intoxicating compound in weed and hemp is illegal. In states such as Georgia, CBD oil must have 0.0% THC – less than the Federal guideline of 0.3%.

As such, one could say it is illegal to mail or use CBD in one of these states. However, it seems as if federal law supersedes the obscure rules of individual states, in this instance. Yes, you could end up in jail for using cannabidiol, but enforcement of the law is practically non-existent.

In South Dakota, Governor Kristi Noem says the compound must remain illegal in spite of federal law. The state’s Attorney General then released a statement in March 2019 that said hemp and CBD are unlawful. Nebraska classifies the compound as marijuana. Even so, the state has a number of CBD stores in operation.

In May 2019, a security officer at Disney World Orlando found a small bottle of CBD in Hester Burkhalter’s purse. He alerted the Orange County Sheriff’s Office. Deputies arrested Burkhalter, and she spent 12 hours in prison. Fortunately, prosecutors dropped the charges. There are a few other arrests for CBD-related ‘crimes’:

  • North Carolina police took a 16-year old girl to jail for having medicinal CBD in her backpack.
  • Louisiana police arrested the owner of a Lafayette CBD store for drug trafficking.
  • Nebraska cops arrested a mother and son team after they opened a CBD store in Scottsbluff.
  • The Ohio authorities charged Robert Faulkner with a felony for possession of half an ounce of CBD oil.

Should I Be Worried About Mailing CBD?

In theory, there is cause for concern. While CBD is as legal as soda in most places, there is a tiny percentage of areas where the substance is treated as an illegal one. However, an incredibly small number of cases make it to court. As with the fiasco in Orlando, those on the receiving end usually escape with no punishment. Authorities in states such as Nebraska talk a good game, but in reality, there are CBD stores all over the place!

Therefore, when companies claim that CBD is “legal in all 50 states,” they do so because of the lack of follow-through when it comes to cannabidiol arrests. Proponents of transporting CBD across state lines have more than one leg to stand on. The 2014 U.S. Farm Bill legalized the cultivation and commercial sale of hemp and hemp extract (including CBD oil). At that time, however, you had to grow it as part of a government pilot program for academic or research purposes.

Even at that point, there were hundreds of companies selling CBD who were not operating as part of such a program. They shipped their products nationwide to all 50 states with practically no consequences.

Effects of the 2018 Farm Bill

The Farm Bill 2018 went much further. It legalized the cultivation of hemp and declassified it as a Schedule I controlled substance. It defined ‘hemp’ as the Cannabis sativa L. plant and any part of the plant with a THC concentration of no more than 0.3%. Interestingly, the FDA confirmed that it is illegal to add CBD to food products or dietary supplements. This is because cannabidiol is an active ingredient in an FDA-approved drug. As such, it is not allowed a nutritional supplement or food supply designation.

The FDA also stated that any product marketed with a therapeutic claim must have the Administration’s approval before its introduction into interstate commerce. If we read between the lines, it suggests that mailing CBD oil is perfectly legal, as long as you don’t make any claims about its ability to heal. In other words, companies that sell CBD oil across the United States are shielded from legal issues if they stick to the facts and continue to educate prospective customers.

What About the DEA?

Even before the 2018 Farm Bill became law, the DEA admitted that it wasn’t trying to crack down on CBD sales. Back in July 2018, a spokesperson for the agency, Rusty Payne, attempted to clarify its stance. Payne said that “hemp was a made-up word,” and products coming from the plant, including CBD, were illegal. Of course, the recent Farm Bill legislation made this a moot point.

What was more interesting was the DEA’s general attitude. Payne said that the nation was in the middle of an opioid epidemic and that the agency had “bigger fish to fry.” More tellingly, he said the following:

“I think people think [CBD] is high on [the DEA’s] priority list right now. It is not.”

Even at that stage, the DEA realized that CBD was not killing people. Since the Farm Bill became law, cannabidiol is even lower down on the DEA’s list. The fact is: Hundreds of CBD companies sell the compound and transport it across state lines every single day. Aside from the occasional anomaly, you don’t hear stories of online stores, in particular, closing down due to law enforcement interference.

The USPS Speaks Out About Mailing CBD

The United States Postal Service (USPS) tried to clear up some of the confusion in March 2019. It confirmed that hemp products are legal to mail under certain circumstances because the plant isn’t a federally controlled substance. On its Postal Bulletin, the USPS said it had received many inquiries from companies and individuals about mailing CBD.

The new USPS policy states that you can mail hemp and hemp-based products like CBD, with a maximum THC content of 0.3% in the following circumstances:

  • You comply with all applicable local, state, and federal laws regarding the production, processing, distribution, and sale of hemp.
  • You retain a record that establishes your compliance with the laws. This record includes lab test reports or compliance reports for at least two years after the mailing date.

You don’t need to present the documentation when you mail the CBD. However, the agency can request it at that time or any date in the future.

This update comes several months after the USPS was embroiled in a legal battle for improperly seizing hemp-derived CBD. The case in question was KAB, LLC v. United States Postal Service. In September 2018, the administrative judge found that

“Congress currently permits the interstate sale, transportation, and distribution of exempt industrial hemp pursuant to the most recent appropriations act; I find that exempt industrial hemp and products derived from exempt industrial hemp are mailable.”

The USPS update acknowledges that the 2018 Farm Bill is law. The agency says once the Federal Government implements the code correctly, it will “modify the mailability criteria for CBD and cannabis products.” What the USPS is saying is that the Farm Bill’s regulatory framework is not yet established and provides “temporary” instructions. In essence, the USPS says it will loosen its guidelines when the Farm Bill becomes clearer.

When Mailing CBD Oil, Know That There’s a BIG Difference Between CBD and Other Cannabis Products

If the laws surrounding mailing CBD across state lines are murky at best, there is no such ambivalence when it comes to marijuana. Cannabis oils containing more than 0.3% THC are undeniably illegal. While there is a slight chance of a CBD package seizure, be sure that the authorities will take action for high-THC products.

Ultimately, you should be on safe ground if purchasing CBD derived from industrial hemp. If it is legal to grow the plant, there seems little reason why the cops would arrest any person using a substance derived from a legitimate crop.

Is It Legal to Mail CBD Oil?: Final Thoughts

The 2014 and 2018 Farm Acts seem to suggest that mailing lawful hemp and CBD is legal. It doesn’t matter whether they have the documentation specified by the USPS. On the plus side, the postal service is developing a method of ensuring that it seizes fewer packages. If nothing else, the guidelines are pragmatic.

Ultimately, the gap between federal and state law makes everything more confusing than necessary. We can’t say that you can definitely send bottles of hemp CBD oil across state lines to your friend. Equally, we wouldn’t know it is illegal either unless, of course, it contains more than 0.3% THC or is derived from cannabis.

The fact is, the authorities are not especially interested in confiscating your CBD package. This is why the industry is booming in the United States. If reputable brands such as PureKana knew it was illegal, do you think they would continue shipping products to all 50 states? At some point, their packages would get seized and ruin their businesses. Law enforcement would have to do the same thing with the hundreds of CBD companies operating in the United States.

For the most part, the authorities in most states exercise common sense. The time and expenses of enforcing such an absurd law are enormous, and most agencies are content to use their resources elsewhere. If you live in a state where CBD is technically illegal, you may need to exercise a degree of caution. Even so, you’ll find that most CBD sellers ship to Nebraska, Idaho, and South Dakota. Why? Because they are confident of avoiding legal consequences.

The CBD market has exploded recently, but there is still much confusion as to whether it is legal to mail CBD oil. Here we explain the most recent laws

CBD Vape Liquid Contains Dangerous Ingredients

Michelle Peace regularly monitors online message boards to see what people are vaping, what got them high, and what gave them bad side effects. As a toxicologist and vaping expert at Virginia Commonwealth University, part of her job is to evaluate how electronic cigarettes are being used for substances other than nicotine.

But the tip about online company Diamond CBD came via phone, she says—someone called and said they purchased a CBD product and got extremely high after taking it. CBD, or cannabidiol, is an ingredient in marijuana that is being studied for various health benefits, but one of its perks is that it’s not inebriating. It shouldn’t have made that person feel intoxicated.

“We thought, ‘Well maybe this kid was just fooling us, you know?” Peace tells me. “Maybe he got it from somebody who adulterated it. Nonetheless, we ordered a bunch of their products.”

In a new study in Forensic Science International, Peace and her co-authors published what they found. Out of nine CBD e-liquids from Diamond Gold, four contained a synthetic marijuana called 5-fluoro MDMB-PINACA (5F-ADB). One contained dextromethorphan, an ingredient in cough syrup.

Everything You Need to Know About K2, the Dangerous Weed Knockoff

Synthetic marijuana, also known as K2 or Spice, is a chemical that is different from naturally occurring cannabis, but binds to similar receptors in the brain, and can sometimes have similar psychoactive effects. It can be extremely dangerous. It’s a gamble what chemical compound you actually get when you buy synthetic marijuana, and it can cause side effects like agitation, confusion, dizziness, lack of coordination, sedation, and even seizures. In 2014, the Drug Enforcement Agency (DEA) reported 2311 incidents involving medical intervention or death involving 5F-ADB.

Dextromethorphan is used in cough syrups and can cause “agitation, ataxia, hypertonic, sedation and may produce dissociative hallucinations at high doses,” the new paper says. Teens are increasingly using it to get high, and it’s one of the most frequent over-the-counter causes of poisoning for people aged 13 to 18. In large doses, dextromethorphan is abused to achieve similar highs as PCP and ketamine.

CBD can be taken many ways, and one is by vaping it in an e-cigarette with a CBD e-liquid. People buy these vaping liquids in stores, and also in a growing number of online retailers.

Everything We Know About the Health Risks of Vaping CBD

Peace and her colleagues bought the same two products their caller had taken, Liquid Gold Strawberry and Diamond CBD Vape Additive, and seven more to test. They purchased them directly from diamondcbd.com. They analyzed the ingredients using Direct Analysis in Real Time Mass Spectrometry (DART-MS) and Gas Chromatography Mass Spectrometry (GC/MS)—both powerful and validated methods of separating and identifying chemicals.

All of the liquids did have CBD in them. But two contained THC, a compound in weed known to get you high and one that a pure-CBD product is not expected to contain more than .3 percent of. Meanwhile, a product called Diamond CBD Vape Additive was found to contain dextromethorphan, while Liquid Gold Jungle Juice, Liquid Gold Strawberry, and also the Diamond CBD Vape Additive contained the synthetic marijuana.

Diamond CBD did not respond after multiple attempts for comment. In an article from earlier this month, Consumer Reports wrote:

Diamond CBD’s chief executive officer, Kevin Hagen, told CR that current formulations of the products differ from those that were tested. He also said that the company’s products are subject to third-party testing and that as a result of Consumer Reports’ questions and the study findings, it planned to retest all its products and issue a recall if they are found to have been adulterated. “The company strives to provide the assurance that we supply the best, highest-quality products on the market,” Hagen said, adding that he supports regulation to ensure the safety and quality of CBD products.

It’s relatively common to find THC in CBD products, including vape liquids, says Kevin Hill, an addiction psychiatrist at Beth Israel Deaconess Medical Center and an Assistant Professor of Psychiatry at Harvard Medical School. A paper from 2017 in The Journal of the American Medical Association looked at a variety of online CBD products and found that only 30 percent were labeled to match what was actually in them. Some had more or less CBD than advertised, and some had additional compounds. 21 percent also had THC in them. This could have an important impact, for example, on a drug test taken for employment.

“The major issue would be problems or feelings associated with THC that you’re not anticipating, such as euphoria or paranoia or hallucinations, perhaps,” Hill says. “These are things that you’re not bargaining for.”

Finding the synthetic marijuana and dextromethorphan was unexpected and alarming, Peace says. “People are going to a website that claims purity, all-natural, nothing synthetic,” she tells me. “People are going on there who are looking for alternative therapies for seizures or pain, so they are health-compromised and they don’t know that these products are potentially adulterated. There’s no indication. There’s no warning about it on the website. There are no reviews from users that say anything.”

Taking synthetic marijuana alone is more harmful than taking it in conjunction with CBD—the latter can dampen some of the effects of the former, Hill says. “That’s why we see so many people having so many problems with synthetics [alone],” he adds. “They will become psychotic, they could have hallucinations, things of that sort.”

The overall problem, Hill says, is the discrepancy between federal and state handling of CBD. Many states have legalized medical marijuana and CBD, but according the federal government, CBD is still illegal. (Though one formulation of CBD, Epidiolex, was recently approved by the FDA for to treat seizures associated with two forms of epilepsy.)

CBD Products Are Everywhere, but Is CBD Legal? Not Exactly

“I think one of the major misconceptions about CBD is that people feel, because they can get it online or they can get into the dispensary, that it’s legal,” Hill says. “Technically all of the CBD aside from Epidiolex is federally illegal still.

In practice, this leads to inadequate regulation and oversight, in the same way that nutraceuticals and other over-the-counter supplements aren’t properly screened and labeled. “People are looking for these alternatives and they are not anticipating that they’re going to take something that at the end of the day might send them to the hospital,” Peace says.

CBD is still being studied for various medical applications and needs more randomized clinical trials before it can be claimed as helpful for things like anxiety and pain. But if you find yourself wanting to try out CBD, which is relatively safe, Hill recommends seeking out a state-operated dispensary, which is obligated to have accurate labeling. Hill also says you should tell your doctor you’re taking CBD, so they know about any drug interactions or can help you navigate any potential side effects.
